When using WPdev.us website, and all websites within WPdev.us network (the “Websites”), you agree to the following terms and conditions (the “Terms of Use”). You can always check out the most current version of these Terms of Use at this page. In addition, when using Websites, you shall be subject to any posted guidelines applicable to that particular website. If you do not agree to these Terms of Use please do not use any of the Websites and do not register to be a member of any Website. We reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms of Use at any time. Please check these terms periodically for changes. Your continued use of the Websites following the posting of changes to these terms (including WPdev.us’s Forum Guidelines) will mean you accept those changes.
Our Services
WPdev.us provides internet web hosting and associated services and maintains dedicated server computers, other equipment and software which is integrated with the internet. These servers send and receive data and information in relationship to the internet. Customers utilize the hardware and software resources of WPdev.us to establish an internet web presence.
Conditions
The Customer’s application and this Agreement constitute a legal and binding contract between WPdev.us and the Customer and does not extend to any other person or entity.
Warranties
With respect to the services to be provided herein, the Customer acknowledges that WPdev.us makes absolutely no warranties whatsoever, express or implied. As a result, the Customer agrees that WPdev.us shall not be liable to the Customer for any claims, damages, or loss of profit which may be suffered by the Customer or any other entity in any respect for direct, indirect, consequential, actual, or punitive damages arising out of, or in relation to, the services provided herein, including, but not limited to, losses or damages resulting from the loss of data as the result of delays, non-deliveries, or service interruptions.
Information
The utilization of any data or information received by the Customer from the utilization of the service to be provided by WPdev.us is at the Customer’s sole and absolute risk. WPdev.us specifically disclaims and denies any responsibility for the completeness, accuracy, or quality of information obtained through the services to be provided hereby.
Payment and cancelation
Payment is due according to the selected fee schedule following the establishment of the hosting service on the internet. Web space and services will automatically be billed 1 month or 12 months in advance according on the selected fee schedule associated with the web hosting plan. In the event that the Customer fails to pay for such services in advance, WPdev.us shall be entitled to suspend the Customer’s service without notice until payment is made. If the account is delinquent for another billing cycle, then it will be deactivated, which will result in all files and email being deleted from the server. The customer accepts financial responsibility for all bandwidth and compute cycle use.
A US$25.00 service fee will apply to each credit card chargeback (multiple chargebacks will each be billed $25.00 each). If a customer initiates a chargeback, then their account will be immediately suspended and the suspension will only be removed once the chargeback is reversed by the customer or the charges paid in full, including any chargeback fees.
The customer will continue to be billed until the customer cancels their hosting account by contacting us. The customer is liable for all services rendered and billed up until the time that the account is canceled. Hosting charges are not pro-rated when an account is canceled.
Community Standards and Conduct in Websites
You acknowledge that all Content, whether publicly posted or privately transmitted, is the sole responsibility of the person from which such Content originated. This means that you are entirely responsible for all Content that you post, email or otherwise transmit via the Websites’ Service. WPdev.us does not control all of the Content posted via the Websites’ Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Websites’ Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will WPdev.us be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the Websites.
